By using b-online products, you agree to be bound by the terms and conditions reproduced below. For the purposes of this contract, the following terms have the definition and scope referred to herein:
Access to the software: The software is accessed by the user (the client) via the Internet through any browser.
User account: User’s e-mail address. Access address: Website https://flexfaturacao.pt/ or http://www.c-lab.pt/ or https://www.paychart.pt/ or other, to be informed by the service provider.
Software location: The software is installed on a server of the service provider, b-online.
Payment for the service: The customer pays an amount, by way of rent, to use the software for the contracted period of time.

B-ONLINE products: Invoicing software (Start, Light and Strong), cash management software (PayChart) and accounting process optimization tools (b-toc and c-lab).
Ownership of the software: The software is the property of the service provider, b-online.
Service: SaaS – software as a service – software rental service.
User: Natural or legal person who contracts access to the service.
A) Terms of Service:
b-online reserves the right to update and change the terms of service from time to time and without prior notice. Such changes will be communicated to the user by e-mail and will take effect on the first day of the month following the month in which they are communicated.
If you do not agree with the change, you have the right to terminate your use of the b-online software at the end of the month in which you were notified of the change, without any penalty or compensation. Use of the service by the user after the entry into force of the changes to the terms and conditions of the provision of services shall be deemed to be express acceptance of such changes.
The user can consult the updated version of the terms of service at any time by accessing terms and conditions.. Breach of any of the conditions set out in the terms of service shall entitle b-online to terminate the account of the offending user. Any functionality that improves or enhances the current service, including the launch of new functionalities and features, is subject to the conditions set out in these general terms of service.
The user accepts and agrees that b-online cannot be held responsible for any content inserted by the user into the service. The user expressly accepts that he/she assumes his/her own risk in using the service.
B) Account Terms of Use:
In order to subscribe to the service, the service user must provide their full identity (name or corporate name, address or registered office, tax number), a valid email address and any other additional information requested by the service provider. The login to the Account can only be used by one user, and it is not permitted for several people to share a single login.
You are solely responsible for maintaining the security of your personal, individual and private account and password. b-online shall not be liable for any loss or damage arising from your breach or failure to comply with this security obligation.
By disclosing information generated in the software, the user declares that he/she is the owner of such content and releases b-online from any and all liability of any kind, including fiscal or parafiscal liability. The user may not use the service for any illegal, illicit, fraudulent or unauthorized purposes.
C) Terms of Use:
The customer is solely responsible for the decision to increase or reduce the number of users on their account. The user expressly understands and accepts that b-online cannot be held liable in any way whatsoever for damages of any kind resulting from the use of the software by the user or by a third party accessing the user’s data via the software.
b-online reserves the right at any time, for technical reasons beyond its control, to temporarily suspend access to the service (or any part of it) with or without prior notice. b-online may suspend the service or part of it whenever it detects the need to change or correct the software, notifying the user by any reasonably understandable means.
The user expressly agrees to b-online automatically providing him with changes and corrections as part of the service. In the event that the service is permanently discontinued, b-online will inform the user of this no less than 120 days prior to the effective date of discontinuation.
For customers who, on the effective date of the discontinuance, wish to continue using the products covered by the discontinuance in order to complete the accounting operations for the current financial year, the discontinuance will take effect 90 days after the end of the accounting year. During the notice period, it is up to the client to withdraw all the information by the means available in the application.
After closing the account, b-online will permanently and irreversibly delete all data in the application, except as provided in the following paragraph. At the express request of the customer, made before the account closure date, b-online will provide access to consult the data in the application by subscribing to archive and consultation services during the period of the customer’s choice, from among the options made available by b-online.
The customer is responsible for activating the consultation service before the license expires. In the event that the license has expired and the customer wishes to activate one of the consultation modalities, they may ask B-online to make this service available, upon prior payment and subject to the actual possibility of data availability, given that the license may already have been deleted, in accordance with point 6 above.
b-online shall not be liable to the user or to any third party for any damages that may result or arise from a termination or suspension of the user’s account and/or access to the service.
D) Limitations of use:
– Invoicing software and management tools: For licenses with no document limit, the database hosting space is 3Gb. For each additional Gb, b-online will charge an additional fee. The amount of data entered is unlimited.
– B-TOC: Above the contracted registration limit, b-online will charge an additional amount for additional registration packages. Data availability is unlimited.
– C-Lab: Limitation on the number of records – There is no limit. Limitation on the type and size of document images: allows you to import files in .pdf, .jpeg, .jpg, .png format or others that may be defined by B-online and indicated within the platform, and no larger than 2MB. Each license may be limited to a maximum number of users and/or companies whenever the quality of use of the product is at stake. Larger licenses may be distributed over more than one license. The monthly fee includes the cost of hosting and maintaining the database. The hosting space for the digital archive of documents is 10Gb included in the monthly fee. b-online will charge extra for each additional Gb contracted.
– PayChart: Limiting the number of records – There is no limit. Limitation on the type and size of document images: allows you to import files in .pdf, .jpeg, .jpg, .png format or others that may be defined by B-online and indicated within the platform, and no larger than 2MB. Each basic license includes 3 users, 3 bank accounts and 3 Gb of storage space for the digital archive of documents and contracts. b-online will charge extra for each additional user, bank account or Gb. The monthly fee includes the cost of hosting and the database maintenance service.
E) Terms of Payment, Refund, Upgrade and Downgrade:
Prices for b-online software are published on request, directly with the client, or on the flexfaturacao.pt and paychart.pt websites. Renewal prices for b-online software are published in the “License” menu, under the “renew license” option, within the programs themselves.
Payment for the service will be made by ATM, credit card or MBWAY, according to the methods provided by b-online for each product. The price of the service is charged in advance, according to the periodicity contracted and is non-refundable. If the customer wishes to add one or more users to their account, they will be charged the amount proportional to the time remaining until the expiration date of the contracted package.
In the case of the C-Lab product, the price of the service will be charged monthly, with the price determined according to the number of users and user companies being agreed at the end of each month and with effect for the following month. Complementary services, such as training and setup, for using C-lab will be charged on a budget, depending on customer requests. The extras of PayChart licensing, bank account, user and file space are charged in the following monthly fee or by prepayment in annual contracts. If the client wishes to upgrade an application, they will be charged the difference in the list price of the respective packages when applicable.
Payments by credit card (visa and mastercard) are made through the easypay service.
F) Copyright and content ownership:
All copyright and ownership of the programs is reserved to b-online. The user accepts that the service contains protected and confidential information which is protected by applicable legislation. The user may not duplicate, copy, reproduce, redistribute, reuse any part of the software, service or account, or visual design elements or concepts without express written permission from b-online, under penalty of civil and criminal liability.
b-online does not claim any intellectual property rights over the data that the user enters into the service. b-online undertakes to keep confidential and not to disclose by any means whatsoever, except in compliance with a court order, any data entered by the user when using the software, to which it may have access.
G) General Conditions:
The user assumes their own risk when using the service. The service is provided “as is” and “as available”. Technical support is provided via email to users and active account holders. The service is provided via the Internet, so b-online is not responsible for connectivity failure and the inherent impossibility of using it.
b-online does not guarantee that the service will meet the specific needs of the user or that the service will be uninterrupted, timely, secure or error-free. For any and all questions of whatever nature arising from the application, interpretation or execution of this contract, the courts of the district of Lisbon shall have jurisdiction, expressly waiving any other jurisdiction.
